ΠΡΟΣΦΥΓΗ ΤΟΥ «ΣΥΛΛΟΓΟΥ ΤΩΝ ΑΘΗΝΑΙΩΝ» ΣΤΟ ΕΥΡΩΠΑΙΚΟ ΔΙΚΑΣΤΗΡΙΟ ΔΙΚΑΙΩΜΑΤΩΝ ΤΟΥ ΑΝΘΡΩΠΟΥ ΓΙΑ ΤΑ ΓΛΥΠΤΑ ΤΟΥ ΠΑΡΘΕΝΩΝΟΣ

Στο Ευρωπαϊκό Δικαστήριο Δικαιωμάτων του Ανθρώπου εναντίον του Ηνωμένου Βασιλείου για τα Γλυπτά του Παρθενώνος προσέφυγε ο ιστορικός «Σύλλογος των Αθηναίων», ο οποίος συμπληρώνει εφέτος 120 χρόνια λειτουργίας (1895-2015). Οι γηγενείς της πρωτεύουσας  προβάλλουν το σύνολο των παραβιάσεων των ανθρώπινων δικαιωμάτων τους επί των πολιτισμικών θησαυρών της πόλεώς τους, τους οποίους ο Απόστολος Παύλος χαρακτήρισε «Σεβάσματα των Αθηναίων». Πρόκειται, εξάλλου, περί της μοναδικής παγκοσμίως περιπτώσεως συλήσεως κηρυγμένου από την UNESCO μνημείου οικουμενικής κληρονομιάς (1987) από το οποίο αφαιρέθηκαν δομικά στοιχεία του, όπως είναι οι μετόπες και τα γλυπτά του Παρθενώνος.

Στους σκοπούς του «Συλλόγου των Αθηναίων», όπως αναφέρονται στο Καταστατικό του, μεταξύ άλλων, περιλαμβάνεται ειδικότερα «η φροντίς διασώσεως και συντηρήσεως των με την ιστορία των Αθηνών συνδεομένων μνημείων, έργων τέχνης κ.λ.π.». Στα ιδρυτικά του μέλη  περιλαμβάνονταν οι απόγονοι των Αθηναίων, οι οποίοι αντιστάθηκαν στην σύληση του Παρθενώνος από τον λόρδο Έλγιν. Εξάλλου, από τις πρώτες ενέργειες του Συλλόγου ήταν εκδήλωση που πραγματοποιήθηκε το έτος 1896 για την απελευθέρωση της Ακροπόλεως από τους Τούρκους και στην οποία ο Αντιπρόεδρός του Καθηγητής Θεοδόσιος Μπενιζέλος (1821-1900) ανέφερε ότι ο Παρθενώνας ήταν τόπος καθημερινής λατρείας, ιερό των ιερών, αγαθό ζωής για τους προγόνους και ότι οι Αθηναίοι αντιστάθηκαν στην σύληση των σωζόμενων αγαλμάτων της Ακροπόλεως από τον Έλγιν.

Ο Παρθενώνας αποτελεί το απόλυτο σύμβολο των Αθηνών, της Ελλάδος αλλά και το πιο σεβάσμιο του Δυτικού Πολιτισμού. Η παράνομη απογύμνωσή του από τα δομικά του στοιχεία, από το 1801 έως το 1808, κατ’ εντολήν του λόρδου Έλγιν, αρχικά τότε Πρέσβεως του Ηνωμένου Βασιλείου στην Κωνσταντινούπολη και,  στην συνέχεια, η  στήριξη και σύμπραξη στην μεταφορά τους στην Αγγλία επισήμως από το Ηνωμένο Βασίλειο, καθώς και η από τότε διαχρονική άρνηση επιστροφής τους, αποτελεί, για μία χώρα που ανήκει στον πολιτισμό αυτό, ηθικό θέμα με νομικές διαστάσεις.

Ενδεικτική της στάσεως αυτής του Ηνωμένου Βασιλείου ήταν η τελική άρνησή του να προσέλθει σε διαδικασία διαμεσολαβήσεως, στο πλαίσιο της Διακυβερνητικής Επιτροπής της UNESCO  για την Προώθηση της Επιστροφής Πολιτισμικών Αγαθών στην Χώρα Προελεύσεως. Στην από 26 Μαρτίου 2015 κοινή απάντηση προς την UNESCO του Βρετανικού Υπουργείου Πολιτισμού & Ψηφιακής Οικονομίας και του Βρετανικού Υπουργείου για την Ευρώπη, ανακοινώθηκε η απόφαση του Ηνωμένου Βασιλείου να μην προσέλθει στην διαδικασία διαμεσολαβήσεως για την επίλυση της διαφοράς, που αφορά στα Γλυπτά του Παρθενώνος, τα οποία βρίσκονται στο Βρετανικό Μουσείο. Στην απάντηση αναφέρεται, μεταξύ άλλων, ότι τα Γλυπτά «αποκτήθηκαν νόμιμα από τον Λόρδο Έλγιν σύμφωνα με τους τότε ισχύοντες νόμους» και ότι υφίσταται ιδιοκτησιακό δικαίωμα του Βρετανικού Μουσείου από την αγορά τους.

Όταν το Δ.Σ. του Συλλόγου ενημερώθηκε για την αρνητική αυτή απάντηση, έλαβε την πρωτοβουλία και απόφαση να προσφύγει εντός της 6μηνης προθεσμίας, ως νομικό πρόσωπο  ιδιωτικού δικαίου ενώπιον του ΕΔΔΑ, ανεξάρτητα από τις τυχόν σχετικές νομικές ενέργειες της Ελληνικής Δημοκρατίας. Σε κάθε περίπτωση, η δυνατότητα της Ελληνικής Δημοκρατίας για διακρατική προσφυγή σχετικά με το θέμα αυτό, παραμένει ανοικτή.

Η προσφυγή του Συλλόγου, η οποία έχει ήδη λάβει αριθμό  48259/15 στη Γραμματεία του Ευρωπαϊκού Δικαστηρίου, στρέφεται  κατά της αποφάσεως του Ηνωμένου Βασιλείου για την διακράτηση των Γλυπτών, διότι, σύμφωνα με τα Άρθρα 8,9,10,13 της Ευρωπαϊκής Συμβάσεως των Δικαιωμάτων του Ανθρώπου και το άρθρο 1 του Πρώτου Προσθέτου Πρωτοκόλλου αυτής:

  • Παραβιάζει την υποχρέωση σεβασμού της πολιτισμικής ταυτότητος, ως διάσταση του δικαιώματος σεβασμού της ιδιωτικής ζωής.
  • Παραβιάζει το δικαίωμα σεβασμού της πολιτισμικής συνειδήσεως.
  • Παραβιάζει το δικαίωμα προσβάσεως στην πολιτισμική πληροφόρηση, ως ειδικότερη διάσταση της ελευθερίας της εκφράσεως.
  • Παραβιάζει το δικαίωμα σε αποτελεσματικό ένδικο μέσο, και
  • Παραβιάζει τα δικαιώματα απολαύσεως του μνημείου ως ενιαίου και αδιαίρετου κοινόχρηστου αγαθού.

Ο «Σύλλογος των Αθηναίων» αποβλέποντας στην ευαισθητοποίηση της παγκόσμιας κοινής γνώμης και στην απονομή δικαίου, ευελπιστεί ότι θα επικρατήσει η αλήθεια, θα αποκατασταθεί το μνημείο και θα λάμψουν η ιστορία και η παράδοση επ’ αγαθώ της ανθρωπότητος. Διότι τα Γλυπτά του Παρθενώνος εκπροσωπούν πανανθρώπινες αξίες, με τις οποίες θα συνεχίσουν να τροφοδοτούν τον πολιτισμένο κόσμο από την Αττική γη που τις γέννησε.


APPEAL OF THE «ATHENIANS’ ASSOCIATION» BEFORE THE EUROPEAN COURT OF HUMAN RIGHTS FOR THE ACROPOLIS SCULPTURES

The historical “Athenians’ Association” (Syllogos ton Athinaion), which celebrated 120 years of existence this year (1895-2015), instituted proceedings at the European Court of Human Rights against the United Kingdom regarding the Acropolis Sculptures. The natives of the Greek capital set out the array of violations to their human rights regarding the cultural treasures of their city, characterised by Paul the Apostle as the «devotions of the Athenians». Indeed, this is the sole case worldwide of a UNESCO World Heritage Monument (1987) being despoiled through the removal of structural elements, such as the metopes and sculptures of the Parthenon.

Among the statutory objectives of the “Athenians’ Association”, special mention is made to “the making provision for the preservation and conservation of the monuments, works of art, etc., linked to the history of Athens”. Its founding members comprised descendants of the Athenians who stood up against the despoilment of the Parthenon by Lord Elgin. Besides, one of the very first actions undertaken by the Association was an event organised in 1896 to commemorate the liberation of the Acropolis from the Ottoman Turks and during which its deputy chairman, professor Theodossios Benizelos (1821-1900) mentioned that the Parthenon was a place of daily worship, the holy of holies, a life good for our ancestors and that the Athenians strongly protested against the despoilment of the Acropolis’ extant statues by Elgin.

The Parthenon constitutes the absolute symbol of Athens, of Greece, but also one of the most venerated of western civilization. The illegal stripping of its structural elements, between 1801 and 1808, initially by order of Lord Elgin (then Ambassador of Britain in Constantinople) and, following this, with the support and collaboration for their transportation to England by the United Kingdom officially, as well as the ever-constant refusal since then to return them, constitutes, for a country belonging to this civilization, a moral issue with legal dimensions.

The United Kingdom’s most recent refusal to participate in a mediation procedure, within the framework of UNESCO’s Intergovernmental Committee for Promoting the Return of Cultural Property to its Countries of Origin or its Restitution in case of Illicit Appropriation, is indicative of this stance. In the joint response dated 26th March 2015 addressed to UNESCO, the British Minister of State for Culture and the Digital Economy and the British Minister of State for Europe announced the United Kingdom’s decision not to attend the mediation procedure for resolving the difference concerning the Parthenon Sculptures, which are in the British Museum. This letter mentions, among others, that the Sculptures “were legally acquired by Lord Elgin according to the then prevailing laws” and that the British Museum has a proprietary right as it purchased them.

When informed of this negative answer, the Association’s Board took the initiative and decision, as a legal person governed by private law, to lodge an appeal within the 6-month deadline before the European Court of Human Rights, independently of any relevant legal actions taken by the Hellenic Republic. In any case, the possibility of the Hellenic Republic’s recourse to interstate litigation on this issue remains open.

The Association’s appeal, already filed with the Secretariat of the European Court under application number 48259/15, contests the United Kingdom’s decision to retain the Sculptures, as, according to Articles 8, 9, 10 and 13 of the European Convention on Human Rights and Article 1 of its First Additional Protocol, there is:

  • Violation of the cultural identity as an aspect of “the right to respect for private life” (Article 8 of ECHR);
  • Violation of the cultural identity as an aspect of “the freedom of conscience” (Article 9 of ECHR);
  • Violation of the right to access to cultural information, as an aspect of “the freedom of expression” (Article 10 of ECHR);
  • Violation of the “right to an effective remedy” (Article 13 of ECHR); and
  • Violation of the right to property, in the sense of integral public access to the monument (Article 1 of the Additional Protocol to ECHR).

The “Athenians’ Association” aspiring to raise international public awareness and to have justice rendered , hopes that the truth will prevail, that the monument will be restored and that history and tradition will shine forth for the good of mankind. Because the Parthenon Sculptures, represent universal values, which will continue to fuel the civilized world this time from their birthplace, the soil of Attica.


Der „Verein der Athener” legte im Fall der Parthenon-Skulpturen beim Europäischen Gerichtshof für Menschenrechte Beschwerde ein.

Der “Verein der Athener”, der dieses Jahr sein 120-jähriges Jubiläum feiert (1895-2015), reichte beim Europäischen Gerichtshof für Menschenrechte eine Beschwerde ein gegen Großbritannien zum Thema der Parthenon-Skulpturen. Die alt eingesessenen Athener geben die Verletzung Ihrer Menschenrechte bekannt, welche in Verbindung mit den kulturellen Schätzen ihrer Stadt stehen – der Schätze, die Apostel Paul als „Verehrungsorte der Athener‘ bezeichnete. Es handelt sich außerdem international um den einzigen Fall einer Plünderung eines von der UNESCO als Weltkulturerbe bezeichneten (1987) Monumentes durch die Entwendung von Bauelementen wie Metopen und Skulpturen.

Ziel des “Vereins der Athener”, wie das Statut des Vereins festlegt, ist unter anderem die „Pflege, Bewahrung und Instandhaltung der mit der Geschichte Athens in Verbindung stehender Kulturgüter, Kunstwerke usw.“. Zu den Gründern des Vereins gehören auch Nachkommen der Athener, die sich gegen die Plünderung des Parthenons durch Lord Elgin gewehrt haben. Eine der ersten Aktionen des Vereins war eine Veranstaltung im Jahr 1896 zur Befreiung der Akropolis von den Türken. In dieser Veranstaltung bezog sich der Vizepräsident des Vereins, Professor Theodosios Benizelos (1821-1900) auf den Parthenon: dieser sei ein Ort der täglichen Gottesverehrung, das Heiligtum der Heiligtümer sowie Gemein- und Lebensgut der Vorfahren. Gegen die Entwendung der noch erhaltenen Skulpturen hätten sich die Athener gewehrt.

Der Parthenon stellt das absolute Symbol Athens, Griechenlands und ein der verehrtesten der westlichen Zivilisation da. Die illegale Entwendung seiner Bauelemente in den Jahren 1801 bis 1808, anfangs auf Anweisung von Lord Elgin, dem damaligen Botschafter Großbritanniens in Istanbul, und danach durch die Unterstützung und die Zusammenarbeit Großbritanniens durch den offiziellen Transport nach England, sowie die Weigerung der Rückgabe, stellt für ein Land das dieser Kultur angehört, eine ethische Frage dar mit rechtlichen Aspekten.

Bezeichnend für diese Haltung Großbritanniens war die Weigerung der Teilnahme an einem Vergleichsverfahren im Rahmen des UNESCO-Komitees zur Rückgabe und Restitution von Kulturgut in sein Herkunftsland (Intergovernmental Committee for Promoting the Return of Cultural Property to its Countries of Origin or its Restitution in case of Illicit Appropriation –ICPRCP). In der vom 26. März 2015 gemeinsamen Antwort des britischen Ministeriums für Kultur & Digitale Wirtschaft und des britischen Europaministeriums an die UNESCO wurde die Entscheidung Englands bekanntgegeben, nicht an dem Vermittlungsverfahren zur Lösung des Disputes über die sich im britischen Museum befindenden Parthenon-Skulpturen teilzunehmen. In dieser Antwort wird u.a. argumentiert, dass die Skulpturen „nach dem damalig geltenden Recht, rechtmäßig von Lord Elgin erworben wurden“ und, dass durch den Kauf dieser ein Eigentumsrecht des Britischen Museums entstand und besteht.

Als der Vorstand des Vereins von dieser Absage erfuhr, ergriff er die Initiative und entschied, sich innerhalb der 6-monatigen Frist an den Europäische Gerichtshof für Menschenrechte als private Institution zu wenden und das, unabhängig von möglichen weiteren rechtlichen Schritten des griechischen Staates. Die Möglichkeit Griechenlands auf staatlicher Ebene rechtlich aktiv zu werden bliebt hiermit unberührt.

Die Beschwerde des Vereins, der vom Sekretariat des Gerichts die Protokollnummer 48259/15 erhielt, richtet sich gegen die Entscheidung Großbritanniens, den Besitz der Parthenon-Skulpturen nicht aufzugeben, da dadurch gemäß Artikel 8, 9, 10 und 13 der Europäischen Menschenrechtskonvention sowie Artikel 1 des ersten Zusatzprotokolls folgende Rechte verletzt werden:

  • die Pflicht zur Achtung der kulturellen Identität, als Aspekt des Rechts auf Achtung des Privat- und Familienlebens
  • die Pflicht zur Achtung des kulturellen Bewusstseins
  • das Recht auf Zugang zur kulturellen Information als spezieller Aspekt der freien Meinungsäußerung
  • das Recht auf Einlegung eines effizienten Rechtsmittels
  • das Recht, das Kulturgut als ein einheitliches, unteilbares Gemeingut zu genießen.

Der “Verein der Athener” zielt auf die Sensibilisierung der weltweiten öffentlichen Meinung sowie der gerechten Rechtsprechung und hofft, dass sich die Meinung durchsetzen wird, das Kulturgut wiederherzustellen und dass die Geschichte und die Tradition für das Wohl der Menschheit überwiegen werden. Denn die Parthenon-Skulpturen vertreten Werte der gesamten Menschheit, die weiterhin die zivilisierte Welt vom attischen Boden aus ausstrahlen werden.


REQUÊTE DE L’« ASSOCIATION DES ATHÉNIENS » À LA COUR EUROPÉENNE DES DROITS DE L’HOMME CONCERNANT LES SCULPTURES DU PARTHENON

L’ « Association des Athéniens » qui, cette année, célèbre 120 années d’activités (1895-2015), a saisi la Cour Européenne des Droits de l’Homme contre le Royaume-Uni concernant les Sculptures du Parthénon. Les membres de l’Association, natifs de la ville d’Athènes, ont fait valoir l’ensemble des violations des droits de l’homme sur concernant les trésors culturels de leur ville que l’Apôtre Paul a qualifié de « monuments sacrés » des Athéniens. Il s’agit d’un cas unique de mutilation d’un monument déclaré patrimoine universel par l’UNESCO en 1987 et auquel on a arraché des éléments structurels, tels que les métopes et les sculptures.

Les buts de l’ « Association des Athéniens » comme ils sont indiqués dans ses Statuts, sont entre autres, « le soin de la sauvegarde et de l’entretien des monuments, œuvres d’art, appartenant à l’histoire d’Athènes etc. ». Parmi les membres fondateurs de cette Association sont compris les descendants des Athéniens qui étaient les premiers à réagir contre la profanation du Parthénon par Lord Elgin. Par ailleurs, parmi les premières démarches de l’Association figure une manifestation qui a eu lieu en 1896, à l’occasion de la libération de l’Acropole de l’occupation ottomane et pendant laquelle, son Vice-président, le Professeur Theodossios Benizelos (1821-1900) a mentionné que le Parthénon avait été un lieu de culte quotidien, saint des saints, un bien vital pour les anciens, et que les Athéniens avaient résisté à la profanation et au saccage des statues de l’Acropole par Lord Elgin.

Le Parthénon constitue le symbole absolu des Athéniens et de la Grèce, mais il est également un symbole parmi les plus respectés de la Civilisation Occidentale. Le démantèlement illégal de ses éléments structurels, de 1801 à 1808, initialement par ordre de Lord Elgin, Ambassadeur à l’époque du Royaume-Uni à Constantinople, et par la suite, avec le soutien et la collaboration officielle de son successeur à la même Ambassade pour leur transport en Angleterre, ainsi que le refus continu de les restituer, constitue, pour un pays qui se réclame de cette civilisation, une question morale avec des implications juridiques.

Le refus définitif de se présenter à la procédure de médiation, dans le cadre de la Commission Intergouvernementale de l’UNESCO pour la Promotion du Retour des Biens Culturels au Pays d’Origine est indicatif de l’attitude du Royaume-Uni. Dans la réponse commune du Ministère Britannique de la Culture & de l’Économie Numérique et du Ministère Britannique pour l’Europe, datant du 26 mars 2015, le Royaume-Uni a annoncé sa décision de ne pas se présenter à la procédure de médiation pour la solution du différend concernant les Sculptures du Parthénon qui se trouvent au Musée Britannique. Dans cette réponse, il est mentionné entre autres, que les Sculptures « ont été légalement acquises par Lord Elgin conformément aux lois en vigueur à l’époque » et que depuis leur achat le Musée Britannique en est le propriétaire.

Lorsque le Conseil d’Administration de l’Association des Athéniens a été informé de cette réponse négative, il a pris l’initiative et la décision de saisir la Cour Européenne des Droits de l’Homme, dans un délai de six mois, en tant que personne morale de droit privé, indépendamment des démarches juridiques éventuelles de la République Hellénique. Dans tous les cas, la possibilité reste ouverte pour la République Hellénique en ce qui concerne une requête interétatique concernant ce sujet,.

La requête de l’Association auprès du Greffe de la Cour Européenne avec le no 48259/15, conteste la décision du Royaume-Uni de détenir ces Sculptures, car, conformément aux Articles 8, 9, 10, 13 de la Convention Européenne des Droits de l’Homme et l’Article 1 de son Premier Protocole Additionnel il y a:

  • Violation de l’obligation de respect de l’identité culturelle comme dimension du droit au respect de la vie privée.
  • Violation du droit au respect de la conscience culturelle.
  • Violation du droit d’accès à l’information culturelle, dimension particulière de la liberté de l’expression.
  • Violation des droits de jouissance du monument comme bien public unique, indivis et d’usage commun.

L’« Association des Athéniens » en visant à sensibiliser l’opinion publique internationale au respect du droit, espère que la vérité historique dominera, que les sculptures du Parthénon seront restituées et que l’histoire et la tradition prévaleront dans l’intérêt de l’humanité. Les Sculptures du Parthénon représentent des valeurs universelles, qui continueront à enrichir l’humanité depuis leur terre d’origine, l’Attique.
